Sanusi's court challenge against FG suffers power setback

Lagos - The suit suspended Central Bank of Nigeria (CBN) Governor, Mallam Sanusi Lamido, filed against the Financial Reporting Council of Nigeria has again failed to take off at the Federal High Court in Lagos because of another power outage. The matter was also stalled last week as the generating sets at the court were reported to have packed up. The judge subsequently adjourned that matter to Thursday next week. The embattled CBN Governor had sued the council challenging its power to investigate him over alleged financial misappropriation. Sanusi is also seeking a declaration that conduct, action, decision and conclusion by the council as manifested in brief note in June 2013 sent to the President were ultra vires and contravened the rules of natural justice.? ?Sanusi wants the court to declare the council did not have the power to conduct the purported investigation as advertised in newspapers. He also sought an order restraining the defendants and their agents in any form from conducting or continuing any investigation, inquiry, hearing or proceeding whatsoever as advertised in the media. ?Sanusi is also urging the court to set aside and nullify any report, conclusion and recommendation based on any purported investigation conducted as advertised. ?When the case was mentioned last week, defence counsel, Adesegun Ajibola, raised an objection that the court lacked jurisdiction to hear the suit as they have filed preliminary objection to that effect.
